Terms of Service

These Terms of Service (“Terms”) govern your use of the Ask4Transport website and mobile app (the “Service”), operated by Ask4Transport (“we”, “us”) in Kenya. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
What Ask4Transport is
Ask4Transport is a negotiation-based transport marketplace that connects customers who need to move cargo, passengers, water, or other goods with independent drivers and fleet owners. We do not own, operate, or control the vehicles listed on the Service, and we are not a party to the transport agreement formed between a customer and a driver.
Accounts and eligibility
- You must be at least 18 years old to create an account.
- You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
- Drivers and fleet owners must provide accurate identity, licence, vehicle, and insurance documents, and must hold all licences and permits required by Kenyan law to operate the vehicle they list.
- We may suspend or terminate an account that provides false information, violates these Terms, or poses a safety or fraud risk.
Bookings, bidding, and payments
- Customers post trip requests; drivers submit bids; a trip is confirmed once a customer accepts a bid.
- Prices are negotiated between customers and drivers. Ask4Transport does not set or guarantee prices.
- Payments are processed through our payment provider, Paystack. You agree to Paystack's applicable terms when making or receiving a payment through the Service.
- You are responsible for any taxes arising from your use of the Service.
Conduct
You agree not to misuse the Service, including by providing false trip or identity information, harassing other users, circumventing the platform to avoid fees, or using the Service for unlawful transport of goods or persons.
Disclaimers and liability
The Service is provided “as is”. We do not guarantee the availability, conduct, or performance of any driver, fleet owner, or customer. To the fullest extent permitted by Kenyan law, Ask4Transport is not liable for loss, damage, injury, or delay arising from a trip arranged through the Service, except where caused by our own gross negligence or willful misconduct.
Termination
You may stop using the Service and delete your account at any time — see the Privacy Policy for how. We may suspend or terminate your access for breach of these Terms.
Governing law
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kenya.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new “last updated” date.
